Sonic Boom uses information we collect to operate, maintain and provide you the features and functionality of the Site and the Services, to fulfill orders and collect payment, to communicate with you regarding various matters, to analyze how the Site and the Services are used, to diagnose service or technical problems, maintain security, personalize content, remember information to help you efficiently access your User Account, monitor aggregate metrics such as total number of visitors, traffic, and demographic patterns, and track content and users as necessary to comply with the California Online Privacy Protection Policy Act, the Digital Millennium Copyright Act, and other applicable laws.
You or your employer may provide us information about yourself, such as your name, date of birth, gender, e-mail address, mailing address, telephone number, date of birth, any other identifying information that permits us to contact you physically or online, and to enable us to establish your user profile, which you may edit on the Site. In some cases, the last 4 digits of your social security number or your employee identification number will be used in connection with the Sonic Boom Site-registration process. This information is strictly used to authenticate your identity and is not used, shared, or discoverable by other users. Your name and other information you choose to provide on the Site will be viewable and discoverable by other users, in accordance with your personal settings on the Site. In order to benefit fully from the Sonic Boom Services, you can also add additional personal details to your User Account, such as your height, weight, gender, age, etc.
In some cases, your organization may authorize us to integrate your health-related data from external sources, which will be subject to federal Health Insurance Portability and Accountability ACT (HIPAA) guidelines to protect your personally identifiable information and your protected health information (PHI). In order to exchange data with, or integrate data from, an external vendor, we establish a Business Associate Agreement (BAA) with each vendor, contractually obligating each party to fully comply with the privacy-protection laws required by HIPAA. Your PHI is not viewable by your employer, and any aggregate data shared with your employer will be de-identified.
If you are a business, we may collect information about your business, including, without limitation, your (or your organization's) name, email address, street address, telephone number, tax identification number, payment information, and information about your website (e.g., the URL, the number of unique users and page views, the demographics of your user base, etc.).
You also provide us information by posting it to the Site or mobile application. Your information and metadata (which is a set of data that describes and gives information about other data) about your information may be viewed by other users in accordance with your settings on the Site. Sonic Boom can, but has no obligation, to monitor the information you post on the Site. We can remove any information you post for any reason or no reason. Unless information is made viewable in accordance with your settings on the Site, Sonic Boom and Sonic Boom employees may view your information (i) to communicate with you about various matters pertaining to the Site and the Services, (ii) to process orders and shipments, (iii) to maintain, provide or improve the Site; (iv) to help you and resolve your support requests. (v) Provide you with health-coaching services, or (vi) Answer questions related to progress toward incentives, which may include outcomes-based activities linked to biometric results or improvements.
When you use the Site, we may send one or more “cookies” – a small data file – to your computer to uniquely identify your browser and let Sonic Boom help you log in faster and enhance your navigation through the Site. A cookie may convey to us anonymous information about how you browse the Site. A persistent cookie remains on your hard drive after you close your browser so that it can be used by your browser on subsequent visits to the Service. Persistent cookies can be removed by following your web browser’s directions. A session cookie is temporary and disappears after you close your browser. You can reset your web browser to refuse all cookies or to indicate when a cookie is being sent. However, some features of the Service may not function properly if the ability to accept cookies is disabled.
When you use the Site, our servers automatically record certain information sent by your web browser. These server logs may include information such as your web request, Internet Protocol (“IP”) address, browser type, referring / exit pages and URLs, number of clicks and how you interact with links on the Site, domain names, landing pages, pages viewed, mobile carrier, and other such information.
When you use the Site, we may employ clear gifs (also known as web beacons) which are used to track the online usage patterns. In addition, we may also use clear gifs in HTML-based emails sent to our Participants to track which emails are opened by recipients. The information is used to enable more accurate reporting and make Sonic Boom better for our Participants and the public.
When you use the Site by or through a mobile device, we may access, collect, monitor and/or remotely store “location data,” which may include GPS coordinates (e.g., latitude and/or longitude) or similar information regarding the location of your mobile device. Location data may convey information about how you browse the Site to us. Location data does not collect or share any personally identifiable information about you. Location data may be used in conjunction with personally identifiable information. Some features of the Site and the Services, particularly location-based services, may not function properly if use or availability of location data is impaired or disabled.
When you access the Site by or through a mobile device, we may access, collect, monitor and/or remotely store one or more “device identifiers.” Device identifiers are small data files or similar data structures stored on or associated with your mobile device, which uniquely identify your mobile device and are used to enhance your use of the Site and the Services. A device identifier may be data stored in connection with the device hardware, data stored in connection with the device’s operating system or other software, or data sent to the device by us. A device identifier may convey information to us about how you use the Site and the Services. A device identifier does not collect or share any personally identifiable information about you. A device identifier may be used in conjunction with personally identifiable information. A device identifier may remain persistently on your device, to help you log in faster and enhance your navigation through the Site. Some features of the Site or the Services may not function properly if use or availability of device identifiers are impaired or disabled. Sonic Boom may access, collect and/or store device identifiers upon enabling Sonic Boom’s Services.
Sonic Boom does not share any of your personally identifiable information (PII) with third parties during the course of using the Site.
We will display your personal information in your profile page and elsewhere on the Site according to the preferences you set in your User Account. Any information you choose to provide should reflect how much you want others to know about you. Please consider carefully what information you disclose in your profile page and your desired level of anonymity. You can review and revise your profile information at any time.
When you make a purchase or otherwise utilize the Site or the Services, we may need to provide your information to certain third-party service providers, including information such as your shipping address, billing information, telephone number, credit card information, etc. Such third-party service providers include product manufacturers, wearable device manufacturers, biometric screening vendors, shipping companies, parties used in the sending of postal mail or emails, accounting and record keeping functions, advertisements and other web-based services. Your information is disclosed to such third-party service providers only as necessary and solely to complete the transaction for which they have been engaged by us. Such third-party service providers will have access to your information for the limited purpose of completing their intended function, but they may not use it in connection with or for any other purpose.
Protection of Sonic Boom’s Rights: Sonic Boom may disclose your personal information if required to do so by law or subpoena, or if we believe that it is reasonably necessary to comply with a law, regulation or legal request; to protect the safety of any person; to address fraud, security or technical issues; or to protect Sonic Boom’s rights or property.
The security of your information is important to us. When you enter any information (such as height or weight) as part of the Site and the Services, we encrypt the transmission of that information using secure socket layer technology (SSL). Sonic Boom uses commercially reasonable physical, managerial, and technical safeguards to preserve the integrity and security of your personal information once we receive it. For example, we regularly back up your data to help prevent data loss and aid in data recovery. We also guard against common web attack vectors, host servers and data only in secure SSAE 16-audited data centers, and implement firewalls and access restrictions on our servers to secure our network and better protect your information. In addition, our business practices are reviewed periodically for compliance with policies and procedures governing the security and confidentiality of our information. However, no method of electronic transmission of storage is 100% secure and we cannot ensure or warrant the absolute security of any information you transmit or store in the Site.
Your access to the Services and certain Content is password protected. We advise that you do not disclose your password to anyone. In addition, we recommend that you sign out of password-protected services at the end of your session. You must immediately notify us of any unauthorized use of your password or User Account.
You may, of course, decline to submit personally identifiable information through the Site, in which case Sonic Boom may not be able to provide certain services to you. You may update or correct your account information at any time by logging into your User Account.
We may use your email address to send you notices regarding matters, including the Site and Services (including any notices required by law, in lieu of communication by postal mail). If you do not want to receive these messages, you can opt out by following the instructions included in the email message or by emailing us at firstname.lastname@example.org. If you correspond with us by email, we may retain the content of your email messages, your email address and our responses.
If you would like to cancel your Sonic Boom User Account you may do so by emailing email@example.com. When you request cancellation of your User Account, your personally identifiable information will be deleted, including but not limited your email address, name, photo(s), height, weight and achievements. Archival copies of your account information that exist within our back-up system will be deleted in accordance with our normal back-up expiration schedule. Following cancellation or termination of your User Account, Sonic Boom may continue to utilize de-identified and anonymized historical data associated with your use of the Sonic Boom Site and Services.
The Site offers publicly accessible community services including blogs, and our comment-driven marketing site. You should be aware that any information you provide in these areas, which may include but is not limited to personal stories, photos, names, recipes, and other personally identifiable or proprietary information, may be read, collected, and used by others who access them. Your posts may remain even after you cancel your User Account. Any information you provide in these areas becomes public information. You should exercise caution when disclosing any personal information in these public areas.
Protecting the privacy of young children is especially important. Neither the Site nor the Services are directed to persons under the age of 18. Sonic Boom does not knowingly collect or solicit personal information from anyone under the age of 18, or knowingly allow such persons to register with the Site or the Services. If we become aware that we have collected personal information from a child under the age of 18 without verification of parental consent, we take steps to remove that information. If you believe that we might have any information from or about a child under the age of 18, please contact us at firstname.lastname@example.org.
If we update or change our Participation Agreement (the “Terms of Service”), which is a separate document that applies to Sonic Boom program participants and that must be agreed to prior to your use of the Sonic Boom Services, we will reissue the updated Terms upon your next attempted login.
